近日，中共中央政治局就民法典進(jìn)行集體學(xué)習(xí)。中共中央總書記習(xí)近平在主持學(xué)習(xí)時(shí)強(qiáng)調(diào)，全黨要切實(shí)推動(dòng)民法典實(shí)施，以更好推進(jìn)全面依法治國(guó)、建設(shè)社會(huì)主義法治國(guó)家，更好保障人民權(quán)益。

General Secretary of the Communist Party of China (CPC) Central Committee Xi Jinping emphasized that the whole Party effectively promote the implementation of the Civil Code in order to better advance law-based governance of the country and the building of a socialist country based on the rule of law, and better protect the people's rights and interests. Xi made the remark while presiding over a group study session of the CPC Central Committee's Political Bureau on the Civil Code.

2020年5月28日，十三屆全國(guó)人大三次會(huì)議表決通過(guò)了《中華人民共和國(guó)民法典》，這部法律自2021年1月1日起施行?！吨腥A人民共和國(guó)民法典》共7編、1260條，各編依次為總則、物權(quán)、合同、人格權(quán)、婚姻家庭、繼承、侵權(quán)責(zé)任，以及附則?！吨腥A人民共和國(guó)民法典》是新中國(guó)成立以來(lái)第一部以“法典”命名的法律，是新時(shí)代我國(guó)社會(huì)主義法治建設(shè)的重大成果。民法典在中國(guó)特色社會(huì)主義法律體系中具有重要地位，是一部固根本、穩(wěn)預(yù)期、利長(zhǎng)遠(yuǎn)的基礎(chǔ)性法律，對(duì)推進(jìn)全面依法治國(guó)、加快建設(shè)社會(huì)主義法治國(guó)家，對(duì)發(fā)展社會(huì)主義市場(chǎng)經(jīng)濟(jì)、鞏固社會(huì)主義基本經(jīng)濟(jì)制度，對(duì)堅(jiān)持以人民為中心的發(fā)展思想、依法維護(hù)人民權(quán)益、推動(dòng)我國(guó)人權(quán)事業(yè)發(fā)展，對(duì)推進(jìn)國(guó)家治理體系和治理能力現(xiàn)代化，都具有重大意義，必將推動(dòng)我國(guó)全面依法治國(guó)建設(shè)邁上新臺(tái)階，必將保障中國(guó)特色社會(huì)主義偉大事業(yè)創(chuàng)造新輝煌。實(shí)施好民法典是堅(jiān)持以人民為中心、保障人民權(quán)益實(shí)現(xiàn)和發(fā)展的必然要求，是發(fā)展社會(huì)主義市場(chǎng)經(jīng)濟(jì)、鞏固社會(huì)主義基本經(jīng)濟(jì)制度的必然要求，是提高我們黨治國(guó)理政水平的必然要求。

民法典系統(tǒng)整合了新中國(guó)成立70多年來(lái)長(zhǎng)期實(shí)踐形成的民事法律規(guī)范，汲取了中華民族5000多年優(yōu)秀法律文化，借鑒了人類法治文明建設(shè)有益成果，是一部體現(xiàn)我國(guó)社會(huì)主義性質(zhì)、符合人民利益和愿望、順應(yīng)時(shí)代發(fā)展要求的民法典，是一部體現(xiàn)對(duì)生命健康、財(cái)產(chǎn)安全、交易便利、人格尊嚴(yán)等各方面權(quán)利平等保護(hù)的民法典。

The Civil Code systematically integrates the civil legal norms formed through long-term practices during more than 70 years of New China, drawing upon the Chinese nation's fine legal culture stretching back more than 5,000 years, and mankind's beneficial achievements in building a law-based civilization. The Civil Code reflects the country's socialist nature, conforms to the people's interests and expectations, abides by the country's development and also provides equal protection for people's rights in such areas as life and health, property security, facilitation of transactions and human dignity.

國(guó)家有關(guān)部門要加強(qiáng)民法典相關(guān)法律法規(guī)的制度建設(shè)，把民法典作為行政決策、行政管理、行政監(jiān)督的重要標(biāo)尺。

Relevant state departments should step up the institutional building of laws and regulations related to the Civil Code. The Civil Code should serve as an important scale plate for administrative decision-making, management and supervision.
